Lawsuits Filed Against Makers of Dietary Supplements

Federal prosecutors announced lawsuits against three dietary supplement companies that were accused of containing other ingredients than ones listed, and making health or disease treatment claims that were unsupported by scientific evidence.

VivaCeuticals Inc., under the brand name Regeneca Worldwide, was accused of manufacturing dietary supplements that did not comply with U.S. Food and Drug Administration manufacturing practice regulations. 

The lawsuit specifically names one of VivaCeutical’s products, RegeneSlim Appetite Control, as containing 1, 3 dimethylamylamine or DMAA, an unsafe food additive, but neglecting to put it on the label. 

This past August, the FDA sent a warning letter to Regeneca Worldwide about their use of the controversial ingredient, which is commonly found in weight loss supplements. In their letter, the FDA stated, “To the best of the FDA’s knowledge, there is no history of use or other evidence of safety establishing that [DMAA] will reasonably be expected to be safe as a dietary ingredient.” DMAA is potentially dangerous, because it can cause blood vessels and arteries to become narrow, rising blood pressure, which can cause cardiovascular problems such as shortness of breath, arryhythmia, chest tightening, and heart attack. 

The letter also called for the company to immediately halt production and sales of their RegeneSlim supplement, stating that “failure to immediately cease distribution of your product, ‘RegeneSlim’ and any other products you market that contain [DMAA] could result in enforcement action by the FDA without further notice.” 

Two other major lawsuits were filed against companies that produce dietary supplements for similar reasons. Clifford Woods LLC, under the brand name Vibrant Life, was accused of unlawfully selling products (Taheebo Life Tea, Life Glow Plus, Germanium, and Organic Sulfur) as treatments for diseases such as Alzheimer’s and Cancer. 

USPlabs, and Anaheim based S.K. Laboratories Inc., were accused of importing ingredients from China, and lying about the source and nature of the ingredients in their weight loss supplements. Sitesh Patel, Vice President, has been named as a defendant in the 11 count indictment against the company.

The U.S. Department of Justice alleges that these companies defrauded consumers through the sale of unapproved and misbranded drugs.
